Take Care of Your Pregnant Employees! Workplace Protections Continue to Increase

Also, the PWFA requires employers to post a notice describing its protections in a conspicuous location in the workplace beginning June 27, 2023. Lucky for employers, the Equal Employment Opportunity Commission (EEOC) has already published such a notice which can be found here! "Know Your Rights: Workplace Discrimination is Illegal" Poster | U.S. Equal Employment Opportunity Commission (eeoc.gov). Therefore, starting June 27, employers should remove the prior version of this poster and replace it with this new poster.

The EEOC encourages employers to make the poster available electronically on their website also as a supplement to the required physical posting at the employer's worksite(s). For employers without a physical work location, or for employees who only work remotely and don't visit the employer's workplace on a regular basis, this may be the only posting.

Although this law goes into effect June 27, 2023, we don't yet have EEOC guidance on interpreting and applying the law, though we expect to see some draft regulations soon, so stay tuned! We'll be watching and provide more information as things develop!
